These Terms & Conditions (“Terms”) govern your access to and use of the website https://balitravelandtour.com/ and any services, tours, bookings, packages or products offered through it (collectively, the “Services”). By visiting the Website, booking or using any of our Services you agree to be bound by these Terms. If you do not agree, do not use the Website or our Services.

1. Operator

The Services are provided by Bali Travel & Tour (referred to in these Terms as “we”, “us” or “the Company”). Our contact information is available on the Website. All enquiries, notices or cancellations should follow the contact procedure shown on the Website.

2. Definitions

Customer / You: any person who visits the Website, makes a booking, purchases Services, or otherwise uses the Services.
Booking: any reservation for tours, transport, accommodation, or other travel services made through the Website or with our staff.
Supplier: third-party providers who supply accommodation, transport, guides, activities, or other components of a tour.

3. Bookings and Payments

Bookings are confirmed only when we send a booking confirmation (by email or other channel) and payment is received in accordance with the payment terms stated at time of booking.
We accept the payment methods displayed on the Website. You must provide accurate payment and identity information. We reserve the right to refuse or cancel a booking if payment cannot be verified.
Prices published on the Website are in the currency indicated and include only the items specified. Prices exclude any government taxes, airport fees, visa fees, travel insurance and other third-party charges unless explicitly stated.

4. Deposits, Final Payment & Late Payment

Some products require a deposit to secure a booking; the deposit amount and due dates will be specified at booking.
Final payments must be made by the deadlines stated in your booking confirmation. Failure to pay on time may result in cancellation and forfeiture of deposits.

5. Cancellations & Refunds

Cancellation by you: cancellations must be made in writing (email or form) and are subject to the cancellation policy applicable to the specific product or package. Cancellation fees may apply and are set out at time of booking.
Cancellation by us: we may cancel bookings in exceptional circumstances (e.g., supplier failure, safety concerns). If we cancel, we will offer alternatives or a refund according to applicable law and our cancellation policy.
Refunds, when due, will be processed according to the payment method used and may be subject to administrative deductions.

6. Changes and Amendments

Changes requested by you after confirmation may be possible but are subject to availability and any supplier or administrative fees.
We reserve the right to make changes to an itinerary or supplier arrangements where necessary. Minor changes will not be a cause for refund. For major changes (significant alteration to the essential nature, price or duration), you will be offered options which may include accepting the change, choosing an alternative, or receiving a refund.

7. Travel Documents, Health & Entry Requirements

You are responsible for ensuring you have valid passport(s), visas, health certificates, vaccinations, and other required travel documents. Failure to have correct documents may result in refusal of travel without refund.
Check and comply with entry requirements for Indonesia (and any transit countries) before travel. The Company is not liable for costs incurred due to failure to meet entry/health requirements.

8. Insurance

It is strongly recommended that you obtain comprehensive travel insurance that covers cancellation, medical expenses, personal injury, loss/theft of baggage and personal effects, and any activity-specific risks. Insurance is your responsibility.

9. Health, Safety & Fitness to Travel

Some activities may carry inherent risks. You must disclose medical conditions or mobility limitations at the time of booking that may affect your ability to participate. The Company and suppliers may refuse participation if, in their reasonable judgement, you are unfit to take part or pose a risk to others.

10. Supplier Services & Third Parties

Many components of our Services are provided by independent suppliers. While we select reputable suppliers, we do not operate or control them and accept no liability for their acts, omissions or failures except as required by applicable law.
Where applicable, your contract for supplier-provided services may be governed by the supplier’s own terms and conditions in addition to these Terms.

11. Liability & Limitation of Liability

To the fullest extent permitted by law, Bali Travel & Tour’s liability for direct loss or damage arising out of our negligence, breach of contract or otherwise is limited to the price paid for the relevant Service.
We shall not be liable for any indirect, consequential, special or punitive damages, loss of profit, loss of business, or loss of enjoyment.
Nothing in these Terms excludes or limits liability which cannot by law be excluded, including for personal injury or death resulting from our proven negligence.

12. Behaviour & Compliance

You agree to behave responsibly while participating in Services and to comply with instructions from our representatives and suppliers. We reserve the right to remove from a tour any person whose behavior endangers others or disrupts the tour; such person will be responsible for any extra costs incurred and is not entitled to refund.

13. Intellectual Property

All content on the Website (text, images, logos, graphics) is owned by or licensed to Bali Travel & Tour and is protected by intellectual property laws. You may use content for personal, non-commercial use only and must not reproduce, distribute or create derivative works without our written permission.

14. Privacy

We collect and process personal data in accordance with our Privacy Policy, which is available on the Website. By using our Services you consent to the collection, storage and use of your personal data as described in that policy.

15. Force Majeure

We are not liable for failure or delay in performing our obligations caused by events beyond our reasonable control (including but not limited to natural disasters, war, terrorism, strikes, pandemic, government action, severe weather, supplier insolvency). If a Force Majeure event occurs, we will use reasonable efforts to offer alternatives or issue refunds as appropriate.

16. Complaints & Dispute Resolution

If you have a complaint, please notify us promptly using the contact details on the Website so we can attempt to resolve it. If we cannot resolve the complaint informally, you and we agree to engage in good-faith negotiations to reach a resolution.
These Terms are governed by the laws of the jurisdiction indicated on the Website (or, if not specified, the laws of Indonesia). Any disputes not resolved amicably shall be subject to the exclusive jurisdiction of the courts of that jurisdiction unless otherwise agreed in writing.
